These Terms and Conditions of Use (“Terms and Conditions”) constitute a legal agreement between you (the user) and Ids Wheels S.R.L. (“Ids Wheels”), a company located in Tegucigalpa, Francisco Morazán, Honduras. By using or receiving any service provided by Ids Wheels, you agree to comply with the terms set forth in this Agreement, including any future amendments made to it.
Ids Wheels reserves the right to modify this Agreement or its policies related to the application service at any time. It is the user's responsibility to review the "Terms and Conditions" as they deem necessary.
IDS WHEELS is a service that allows users to request at-home car wash services without water and/or oil changes.
IF THE USER DOES NOT ACCEPT THIS AGREEMENT, THEY WILL NOT BE ABLE TO USE THE SERVICES OR PRODUCTS PROVIDED BY IDS WHEELS.
Key Terms
“User refers to any person who uses the service or application.
“Ids Wheels Content”, refers to any visual or audio content provided and/or developed by Ids Wheels.
“User Content”,refers to any visual or audio content provided and/or created by the User.

Restrictions and Warranties
By using the application, you warrant that you have the powers, authority, and capacity to accept the terms set forth in this Agreement, confirm that you are over 18 years old, and have full willingness to participate in this agreement. Your use of the application is for personal purposes only; your account is non-transferable and you must not authorize any other person or entity to use your personal account.
The User may not copy or distribute the application or its content without prior written authorization from Ids Wheels.
The User is responsible for maintaining the confidentiality of their account and password used in the application.
The User is obligated to provide any reasonable form of identification that Ids Wheels requests in order to verify the User’s legal standing.
Ids Wheels reserves the right to terminate this agreement if it deems it necessary due to inappropriate use of the application or service.
Ids Wheels reserves the right to deny services in any case where the service may pose a danger to its employees, whether due to a risky location or any other hazard the service might entail.
The User agrees not to interfere while the service is being performed, as doing so could pose a risk to the User.
The User agrees not to provide inappropriate content through Ids Wheels’ channels. Such content may be removed by Ids Wheels at its discretion, but Ids Wheels is not obligated to take this action.
Ids Wheels is not responsible for the User's data network usage charges; the User alone is responsible for any charges from their mobile service provider that may result from using data on their device.
The User must not upload or store material containing viruses, worms, or Trojan horses that could be harmful to computer code or files.
The User must not attempt to gain unauthorized access to the application, services, related systems, or network.
Ids Wheels will not be responsible for delays or lack of communication that may be caused by the absence of mobile data service or any other reason beyond the normal activities of the service provided.
Ids Wheels reserves the right to make different types of accounts available to different users, as well as to maintain, modify, manage, or cancel such accounts.
The User may not use, adapt, modify, create derivative material from Ids Wheels’ content, distribute, license, sell, transfer, or advertise by any means the services provided by Ids Wheels without prior written authorization from Ids Wheels.
Ids Wheels reserves the right to investigate and take action against any violations described in the previous sections. Ids Wheels will involve and cooperate with the authorities in the prosecution of users who breach this Agreement.
License Granted by the User
Ids Wheels may, in cases it deems appropriate, allow the sending, online uploading, publishing, supplying, or transmission of User content made available to Ids Wheels through any channel or format, whether visual or audio, including photographs, videos, or recordings related to the provided service. By providing content to Ids Wheels, the User grants a worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to sublicense, use, copy, modify, create derivative works from, distribute, publicly display, or exploit the content in any manner Ids Wheels deems appropriate, in any format or distribution channel, known now or developed in the future, without the obligation to notify or seek consent from the User and without any obligation to make any payment to the User or any other person or entity.
The User acknowledges and agrees that they are solely responsible for any user content made available to Ids Wheels. The User guarantees that they are the sole owner of the content and possess all rights, licenses, and consents necessary to grant Ids Wheels the rights to such content.
Application License
Subject to compliance with these Terms and Conditions, Ids Wheels grants you a limited, non-exclusive, non-transferable, and revocable license to download and install a copy of the application on a single mobile device. Ids Wheels reserves all rights not expressly granted herein for any content available through the application.
Payment Terms
Any charge that Ids Wheels applies to the User is effective immediately and non-refundable, unless Ids Wheels considers the circumstances justifiable and the notification was made within 24 hours of requesting the service. This no-refund policy will remain in effect at all times, even if the User decides to stop using the application.
Ids Wheels is free to offer different promotions with varying prices and services to any of its users. Such promotions or offers, unless specifically directed to you, have no validity and will not affect the contract between the User and Ids Wheels.
The User understands that using the service provided by Ids Wheels will incur charges, which will be paid either by credit card through the electronic transaction provider or via cash payment. In the event that the payment is made in cash, and for any reason the service is canceled or the payment is not collected when the service is provided, the User authorizes Ids Wheels, without any objection, to record the outstanding balance in accounts receivable/debit.
The User may cancel their service order within the first 10 minutes after making the service reservation, in which case a cancellation fee may be charged.
In the event that the User's account is suspended or canceled by IDS Wheels, the User will not receive any compensation from IDS Wheels for any content or information associated with the User's account.
Multiple services may result in multiple charges on the User's monthly credit card statement.
When making a payment for the service through the website or application, the information requested from the User to complete the payment will be handled and transmitted to our electronic payment provider through a secure connection.
Interactions with Third Parties
During the use of the IDS Wheels application, the User may encounter third-party advertisements, which may include, but are not limited to, the purchase of products and/or services. Any interaction between the User and a third party is solely between the User and that third party. IDS Wheels does not guarantee and clarifies that it has no responsibility or obligation regarding such transactions. Therefore, IDS Wheels is not responsible for any content, product, service, or other material available through a third-party advertisement.
By accessing these Terms and Conditions, the User agrees to receive such advertising.
Vehicle Access
By accepting these Terms and Conditions, the User agrees to ensure that IDS Wheels personnel have access to the vehicle’s location and that it is in a safe area where IDS Wheels staff can provide the service without restrictions or delays unrelated to the service itself.
IDS Wheels is not responsible for any damage to the vehicle, including vandalism, fire, theft, collision, accident, or any other material damage or loss that the vehicle may incur during the provision of the service.
Infant Car Seat Policy
It is the User’s responsibility to remove and reinstall any car seat for babies or infants. IDS Wheels personnel will not remove or reinstall the child car seat, even if the User requests them to do so. IDS Wheels is not responsible for any incident that may arise from improper installation of the child car seat, either before or after the service is performed.
Indemnification
By accepting this Terms and Conditions Agreement, the User agrees to hold IDS Wheels, its collaborators, directors, employees, agents, attorneys, and officers harmless from any and all claims, demands, liabilities, and expenses (including attorney’s fees) arising from or related to: (a) the User’s violation of any of these Terms and Conditions; (b) IDS Wheels’ use of the User’s content; or (c) the User’s infringement of the rights of any third party, including third-party providers.
Disclaimer of Warranties
IDS Wheels clarifies that it is not responsible for any matters arising from the provision of IDS Wheels services, such as reliability, punctuality, quality, suitability, availability, accuracy, or fulfillment of the requested services or the application. IDS Wheels does not guarantee that the use of the service or application will be safe, timely, uninterrupted, error-free, or compatible with any type of equipment, application, system, or information; that the system or application will meet the User’s service requirements; that the service or product acquired through the application will meet the User’s requirements or expectations; that errors or defects in the service will be corrected; that the server or servers making the service available are free of viruses or any other harmful content; IDS Wheels does not guarantee the quality, suitability, safety, or capability of third-party providers.
It is acknowledged by the User that through the use of the service or application, all risks that may arise from the use of the service and application, as well as from any third-party service or product provider, rest solely with the User, to the maximum extent permitted by applicable law.
General Provisions
There is no employment, partnership, or agency relationship between the User and IDS Wheels as a result of the contract between the User and IDS Wheels or from the use of the service. IDS Wheels’ failure to enforce any right or warranty under this agreement shall not be considered a waiver of that specific right or warranty, unless IDS Wheels has been notified and there is a prior written agreement from IDS Wheels.
Any dispute or claim that may arise from the service or application will be resolved in accordance with the laws of the Republic of Honduras.
The User is responsible for any damage to their property. IDS Wheels or its collaborators shall not be liable for any loss or damage that may occur before, during, or after the service is provided.
This contract between IDS Wheels and the User shall be governed by and construed in accordance with the laws of the Republic of Honduras.
